concerning the products designed by the designers of the Hiatus design office and sold under the Hiatus and Doctor Alba White brands.

These general conditions of sale are concluded between, on the one hand:

and, on the other hand, the persons, hereinafter referred to as "customers",

purchasing products designed by Hiatus and seen

on the online sales site http://www.hiatus-shop.com.

The customer, prior to his order, declares that the acquisition of these products is not directly related to his professional activity.

As part of a wholesale purchase by a professional, the manager of the store who would like to resell these items may contact Ms. Marano directly to obtain professional prices.

Acceptance of conditions

These general conditions of sale govern the contractual relations between the E.I Hiatus® and its customer during the entire period of transaction and dispatch of the articles.

Any order placed by post or email implies unreserved acceptance by the customer of these general conditions.

Reading the General Conditions below is strongly recommended before sending the order form.

Product information

Any description concerning the products marketed on the e-shop www.hiatus-shop.com does not enter into the contractual field. If errors which do not affect the substantive characteristics of the product have been introduced, in no case shall the liability of the representatives of the Hiatus brand be engaged.

Thus, the customer is aware that between the presentation photographs put on the online store and the real product, there may be variations in colors and aspects of the textiles used.

Order

The individual company Hiatus® undertakes to fulfill orders within the limits of available stocks, and to inform the customer of the waiting time for the preparation of the item (s) ordered. Hiatus will inform the customer by email as soon as the order is made of the availability of the article.

All products, unless otherwise indicated and in the "promotion" category, are made only on order.

The information stated by the buyer, when taking the order commits the latter; it turns out that in case of error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility in which it could be to deliver the product.

Prices

The prices indicated are in Euros.

Hiatus® reserves the right to modify its prices at any time. The price appearing on the e-shop on the day of the order will be the only one applicable to the buyer.

Delivery and Shipping

The products being made to order, the shipping time is approximately 3 weeks unless expressly requested by e-mail.

Delivery is made to the address indicated in the order form, through La Poste (Colissimo).

E.I. Hiatus® therefore declines any responsibility concerning the work carried out by La Poste, and the damage incurred by the parcel during La Poste's intervention *.

The customer can also elect another carrier of his choice on request.

It is the customer's responsibility to always check their package upon arrival.

All reservations or complaints must be made by telephone to Ms. Marano (06 74 63 07 31) within 14 days of receipt.

(* In case of damage during transport, a reasoned protest must be made to the carrier (in this case the Post Office) by registered letter within the time limits set in Article L 133-3 of the Commercial Code i.e. d. within 3 days from the day after the day of filing.)

Withdrawal

The customer has a withdrawal period of 14 days, from the receipt of the items to return the items to the seller either for exchange or for refund, after deduction of the standard order processing and shipping costs.

In the event of an exchange, the shipping costs for the second shipment must be paid by check by the customer.

Items made to measure (belt, chest, length, or other specific adaptations), will not be returned or exchanged.

Sale items under 50 euros are not taken back or exchanged.

In case of payment by credit card or Pay-Pal via the online payment method "Pay-Pal", please refer to the general conditions of withdrawal conditions in force with our service provider.

Payment terms

The customer pays the entire amount when ordering, only in € uros currency, as desired:

- by check made out to Marano Jennifer: receipt of the check will be confirmed by e-mail from contact@hiatus-shop.com,

-in cash, hand delivered to Ms. Marano.

- by bank transfer on request from the IBAN

-by credit card via the e-shop (transaction by Pay-Pal, exchange fees may be charged by Pay-Pal depending on your initial currency)

-by Pay-Pal account (e-mail) to Hiatus Pay-Pal account: contact@hiatus-shop.com

Unless special order, upon receipt of the full amount, the order validated and the manufacture of products is started.

Liability

In the online sales process, the Hiatus® IS has only an obligation of means. Its responsibility could not be engaged for a damage inherent in the use of the Internet network such as for example: loss of data, computer virus, intrusion, rupture of the service.

Intellectual property

All the elements present on the online sales site http://www.hiatus-shop.com are the exclusive intellectual property of Jennifer Marano, responsible for the Hiatus and Doctor Alba White brands. The establishment of a simple or hypertext link must imperatively be the subject of an authorization request to Hiatus (contact@hiatus-shop.com)

Disputes

This contract is subject to French law.

Complaints or disputes will be resolved amicably.

In the event of a dispute and in the absence of an amicable solution, jurisdiction is assigned to the competent courts of Nîmes.

Policy of Discretion

Personal data is protected according to the Data Protection Act, and is not transmitted to third parties. In accordance with the law of January 6, 1978, customers have the right to access and rectify data concerning them. The customer's banking information is inaccessible by a third party.

Shipping and returns

Shipping your package

Packages can also be sent via Chronopost and delivered against signature. Please contact us before choosing this delivery method, as it incurs additional costs. Transport costs vary depending on the total weight of the package. Hiatus® therefore declines any responsibility concerning the work carried out by La Poste, and the damage incurred by the parcel during La Poste's intervention *.

The customer can also elect another carrier of his choice on request.
